AI disclosure

Everything you watch on Kibitz is generated by artificial intelligence and written collaboratively by the audience. Kibitz's characters, voices, places, and events are fictional and AI-generated — they are not real footage, real recordings, or real people, and nothing on Kibitz is a factual statement about any real person, business, product, or event. Any resemblance to a real person or entity is unintended.

AI can make mistakes and produce unexpected results. We use automated and human review to reduce harmful, infringing, or misleading content, but we can't catch everything. Kibitz video is labeled as AI-generated wherever it appears. If you believe something on Kibitz depicts a real person, infringes a right, or is otherwise improper, tell us at hello@kibitz.tv and we'll review it promptly.

Privacy Policy

This policy explains how Kibitz, operated by CUETV LLC ("Kibitz," "we," "us"), collects, uses, and shares information when you join the kibitz.tv waitlist or use our site. By joining, you agree to this policy.

1. Information we collect

We do not collect payment card numbers, government IDs, or other sensitive identifiers on the waitlist, and we do not sell your personal information.

2. How we use it

Operate the waitlist, confirmation emails, referrals, and leaderboard; prevent spam and abuse; measure whether update emails are opened and which links are clicked (opt out anytime by unsubscribing); and tell you about Kibitz's launch and related updates.

3. Service providers

We share data only with vendors that help us run the service, under their own terms: Cloudflare (hosting, database, security) and Resend (email delivery). We do not sell or rent your personal information, and we do not share it for cross-context behavioral advertising.

4. Your choices and rights

Depending on where you live, you may have the right to access, correct, delete, or obtain a copy of your personal information, and to opt out of sale/sharing (we don't sell or share). To exercise any right, email privacy@kibitz.tv. We will not discriminate against you for exercising these rights. You can also unsubscribe from emails at any time.

5. Children

Kibitz is not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child has provided us information, contact us and we will delete it.

6. Data retention & security

We keep waitlist data while the waitlist is active and as needed to operate Kibitz, then delete or de-identify it. Records of safety enforcement and appeals are kept while your account is active and for up to 24 months after deletion, then removed; the limited exception is one-way hashes of content blocked as child-sexual material, which we retain only as required by law. We use reasonable technical measures to protect your data, but no method is 100% secure.

7. Changes

We may update this policy; we'll change the "Last updated" date and, for material changes, take reasonable steps to notify you.

Welcome to Kibitz, operated by CUETV LLC, a Missouri limited liability company ("Kibitz," "we," "us"). By using kibitz.tv or joining the waitlist, you agree to these Terms. If you don't agree, please don't use the site.

1. Eligibility

You must be at least 13 years old to join the waitlist and old enough to form a binding contract where you live. Kibitz is not directed to children under 13. If you believe a child under 13 has given us their information, contact privacy@kibitz.tv and we will delete it.

2. The waitlist

Joining the waitlist does not guarantee access to Kibitz, a launch date, any leaderboard position, or any specific feature. We may change, pause, or discontinue the waitlist or any feature at any time.

3. Acceptable use

Kibitz is a crowd-steered, AI-generated channel held to a PG-13 standard. Two rules sit above the rest: some content is never allowed (and the worst of it can't be appealed), and influence is earned — never bought, brigaded, or faked.

Never allowed: anything that sexualizes a minor or sexual content involving anyone who is or appears to be under 18 (zero tolerance); sexual/explicit content or pornography; a real, identifiable person made to do or say things (non-consensual likeness, deepfakes, defamation, harassment, doxxing); graphic violence or gore, hateful or extremist content, or promotion of self-harm; instructions for weapons, explosives, drugs, or other serious illegality; and content that infringes someone else's copyright or trademark.

Don't manipulate the channel: no vote brigading; no extra or fake accounts; no buying or selling influence, votes, handles, or placement; no spam or queue-flooding; no ban evasion; no scraping, disruption, or unauthorized access.

Enforcement is proportionate and mostly automatic: a rule-breaking cue is declined; repeat issues get tighter limits and reduced influence until behavior is clean; serious or repeated violations can lead to suspension or ban. Minor-sexual content is blocked, escalated, and reported as required by law.

Appeals: email privacy@kibitz.tv from your account address; we aim to respond within 30 days and a person reviews the decision. Decisions involving minor-sexual content are final.

4. Our intellectual property

The Kibitz name and logo, the kibitz.tv site, its design, text, graphics, video, and underlying software are owned by CUETV LLC and protected by intellectual-property laws. "Kibitz" and the Kibitz logo are trademarks of CUETV LLC. Except as expressly allowed, you may not copy, modify, distribute, or create derivative works from our materials without written permission. All rights not expressly granted are reserved.

5. Content you submit; how Kibitz content is made

5.1 Your contributions. You keep ownership of the suggestions, prompts, handles, votes, and other content you submit ("Contributions"). By submitting a Contribution you grant CUETV LLC a worldwide, non-exclusive, royalty-free, fully paid-up, sublicensable, and transferable license to host, use, reproduce, modify, adapt, translate, create derivative works from, publish, publicly perform and display, and incorporate the Contribution into the channel and into Kibitz's products, services, and promotion, in any media now known or later developed. You waive any moral rights to the extent permitted by law.

5.2 Your promises about Contributions. You represent and warrant that: (a) you have all rights necessary to submit the Contribution and grant the license above; (b) your Contribution does not infringe or violate any third party's intellectual property, privacy, publicity, or other rights; (c) your Contribution does not name, depict, impersonate, or target any real, identifiable person, and does not make false or defamatory statements about any real person or entity; and (d) your Contribution complies with the acceptable-use rules in §3.

5.3 Kibitz content is AI-generated and fictional. Kibitz's scenes, characters, voices, dialogue, settings, and events are generated by artificial intelligence from audience input and are works of fiction. They are not real footage, real audio, real people, or real events. Kibitz does not depict real, identifiable individuals; any resemblance to a real person, living or dead, or to any real entity, place, product, or event, is coincidental and unintended. Kibitz content is not news, advice, or a statement of fact, and must not be relied upon as such.

5.4 Labeling. Kibitz labels its video as AI-generated wherever it reasonably can, including on the site and on shareable clips, and applies provenance metadata where available. Kibitz will provide any AI-generation or synthetic-media disclosures required of it by applicable law or rule.

5.5 Automated screening is imperfect. Kibitz uses automated filters and human review intended to reduce content that is infringing, defamatory, that depicts real people, or that is otherwise harmful or unlawful. These systems are not perfect and may both over- and under-block. Kibitz does not warrant that all such content will be detected or removed, and the screening does not create any duty or guarantee to you or any third party.

5.6 Kibitz owns the channel content (to the fullest extent possible). As between you and Kibitz, CUETV LLC owns and retains all right, title, and interest in and to the Kibitz channel and all scenes, characters, voices, dialogue, and other output generated on or for Kibitz, together with all related materials (collectively, "Kibitz Content"), and all intellectual-property rights in them, to the fullest extent such rights exist or may be claimed. To the extent you now have or later acquire any right, title, or interest in any Kibitz Content — including in any output generated from, incorporating, or derived from your Contribution — you hereby irrevocably and exclusively assign all such rights to CUETV LLC, and agree to take reasonable steps to help Kibitz perfect, register, and enforce them. You acknowledge that, under current U.S. law, copyright may not be available for purely AI-generated material; Kibitz nonetheless claims, and you assign, all rights that do or may exist, including in the human-authored, selected, arranged, edited, directed, and curated elements, in the compilation and channel as a whole, and in Kibitz's trademarks, characters, names, and brand. You receive no ownership of Kibitz Content by submitting a Contribution or by watching.

5.7 Reporting & takedown. If you believe Kibitz content infringes your rights, depicts you or another real person, or is defamatory or otherwise improper, contact hello@kibitz.tv (for copyright, see our Copyright & DMCA policy and designated agent). We will review and, where appropriate, remove or modify content. We may remove any content and suspend any user at our discretion.

6. Disclaimers; assumption of risk; limitation of liability; indemnity

6.1 "As is." The site, the channel, and all Kibitz content are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or that the service will be uninterrupted, secure, or error-free.

6.2 Fiction; no reliance. Kibitz content is fictional and AI-generated and is provided for entertainment only. It is not advice (legal, financial, medical, or otherwise) and is not a factual representation about any real person, entity, product, or event. You agree not to rely on Kibitz content as fact.

6.3 Assumption of risk. AI-generated media can be unpredictable and may occasionally produce content that is inaccurate, offensive, or unexpected despite our screening. You acknowledge and accept this risk in using Kibitz.

6.4 Limitation of liability. To the maximum extent permitted by law, CUETV LLC and its members, officers, employees, contractors, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or business, arising out of or relating to your use of (or inability to use) the site, the channel, or any Kibitz content, whether based in contract, tort, strict liability, or otherwise, even if advised of the possibility of such damages. Kibitz's total aggregate liability for all claims relating to the service will not exceed the greater of (a) the total amount you paid Kibitz in the twelve (12) months before the claim, or (b) USD $100.

6.5 Exclusions. Some jurisdictions do not allow certain warranty disclaimers or liability limits; in those places the above apply to the fullest extent permitted, and nothing limits liability that cannot be limited by law (e.g., for gross negligence, willful misconduct, or as otherwise required).

6.6 Indemnification. You agree to indemnify and hold harmless CUETV LLC and its members, officers, employees, and contractors from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your Contributions; (b) your use of the service; (c) your violation of these Terms or the acceptable-use rules; or (d) your violation of any law or any third party's rights, including any right of publicity, privacy, defamation, or intellectual-property claim arising from a Contribution you submitted.

6.7 Real-person & defamation safeguards. Kibitz prohibits Contributions that name, depict, impersonate, or defame real, identifiable people, and screens for them; however, responsibility for a Contribution that violates this rule rests with the user who submitted it, and §6.6 applies.

7. Governing law; binding arbitration; changes

7.1 Governing law. These Terms, and any dispute arising out of or relating to them, the site, the channel, or Kibitz Content, are governed by the laws of the State of Missouri, without regard to its conflict-of-laws rules.

7.2 Binding arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the service that is not resolved informally will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its then-current applicable rules, rather than in court — except that either party may bring an individual claim in a small-claims court with jurisdiction. The arbitration will apply Missouri law, be conducted in Jackson County, Missouri, and judgment on the award may be entered in any court of competent jurisdiction. The arbitrator decides all issues, except that a court decides the enforceability of §7.3.

7.3 Individual basis only (class-action waiver); 30-day opt-out. You and Kibitz agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. You may opt out of this arbitration agreement (§§7.2–7.3) by mailing a written opt-out notice — including your name, the email/handle associated with your account, and a clear statement that you opt out of arbitration — postmarked within 30 days of the date you first accept these Terms, to: CUETV LLC, 12201 Washington Ct, Kansas City, MO 64145, Attn: Arbitration Opt-Out. A timely opt-out is the only way to reject arbitration; opting out does not affect any other part of these Terms.

7.4 Changes. Kibitz may update these Terms; material changes will be posted with an updated effective date, and continued use after changes means you accept them.

Kibitz respects intellectual-property rights and expects its users to do the same. We respond to clear notices of alleged copyright infringement under the U.S. Digital Millennium Copyright Act ("DMCA," 17 U.S.C. § 512). Filing a takedown notice

If you believe material on Kibitz infringes a copyright you own or are authorized to represent, send a written notice to the agent above that includes all of the following (17 U.S.C. § 512(c)(3)):

  • Your physical or electronic signature;
  • Identification of the copyrighted work you claim has been infringed;
  • Identification of the material you claim is infringing, with information reasonably sufficient to let us locate it (for example, the URL on kibitz.tv);
  • Your contact information — name, mailing address, telephone number, and email;
  • A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.

On receipt of a complete notice, we will act expeditiously to remove or disable access to the material and will make a reasonable effort to notify the contributor.

Counter-notification

If you believe your material was removed or disabled by mistake or misidentification, you may send a written counter-notification to the agent above that includes (17 U.S.C. § 512(g)(3)):

  • Your physical or electronic signature;
  • Identification of the material that was removed and the location where it appeared before removal;
  • A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification; and
  • Your name, mailing address, and telephone number, plus a statement that you consent to the jurisdiction of the U.S. federal district court for your judicial district (or, if outside the U.S., any judicial district in which Kibitz may be found), and that you will accept service of process from the person who filed the original notice.

If we receive a valid counter-notification, we may restore the material in 10 to 14 business days unless the original complainant first notifies us that they have filed a court action to keep it down.

Repeat infringers

It is Kibitz's policy, in appropriate circumstances, to disable or terminate the accounts of contributors who are repeat infringers.

A note on accuracy

Under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that material is infringing — or was removed by mistake — may be liable for damages. Please be sure of your claim before submitting a notice or counter-notice.

Kibitz is committed to making kibitz.tv usable by everyone, including people with disabilities. We aim to conform to the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA — the standard most widely referenced under the Americans with Disabilities Act (ADA).

What we've done

Respect the OS "reduce motion" setting; visible keyboard-focus indicators and a "skip to content" link; accessible names on all form fields and a main content landmark; captions for our video content.

Ongoing work

Accessibility is continuous. We are reviewing color contrast on small UI labels, adding live-region announcements for form messages, and testing with screen readers.
