Filing a takedown notice

If you believe material on Kibitz infringes a copyright you own or are authorized to represent, send a written notice to the agent above. To be effective under 17 U.S.C. § 512(c)(3), your notice must include all of the following:

On receipt of a complete notice, we will act expeditiously to remove or disable access to the material and will make a reasonable effort to notify the contributor responsible for it.

Counter-notification, in brief

If your material was removed or disabled and you believe it was a mistake or misidentification, you may send a written counter-notification to the same agent. Under 17 U.S.C. § 512(g)(3) it must include your signature, identification of the removed material and where it appeared, a statement under penalty of perjury that you have a good-faith belief the removal was a mistake or misidentification, and your name, address, and phone number together with consent to federal-court jurisdiction and acceptance of service of process from the original complainant. If we receive a valid counter-notification, we may restore the material in 10 to 14 business days unless the original complainant first notifies us that they have filed a court action to keep it down.

Repeat infringers & accuracy

It is Kibitz’s policy, in appropriate circumstances, to disable or terminate the accounts of contributors who are repeat infringers.

And a word of caution: under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that material is infringing — or was removed by mistake — may be liable for damages. Please be sure of your claim before submitting a notice or counter-notice.
